1. Acceptance of Terms

4. User Conduct and Prohibited Activities

• Data Harvesting: Scraping, crawling, or using automated means to extract user data or content from the Platform.

Violations of these conduct rules may result in warnings, temporary suspension, or permanent account termination at the sole discretion of the Company.

5. Intellectual Property Rights

All content, design elements, software, logos, trademarks, graphics, text, and underlying technology of the Platform are the exclusive property of Asian Women Dating or its licensors and are protected under United States and international copyright, trademark, and intellectual property laws.

By uploading content (including photographs, text, and other materials) to the Platform, you grant the Company a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute such content solely in connection with the operation and promotion of the Platform. You retain ownership of your content and may remove it at any time by deleting it from your profile or by deleting your account.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content or materials from the Platform without the prior written consent of the Company.

6. Limitation of Liability and Disclaimers

THE PLATFORM AND ALL ASSOCIATED SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

The Company does not guarantee:

• That you will find a romantic partner or match through the Platform.
• The accuracy, completeness, or reliability of any user-generated content, profiles, or communications.
• Uninterrupted, error-free, or secure access to the Platform at all times.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING DAMAGES FOR LOSS OF DATA, EMOTIONAL DISTRESS, OR PERSONAL INJURY RESULTING FROM INTERACTIONS WITH OTHER USERS.

The Company is not responsible for the conduct of any user, whether online or offline. You assume all risk when communicating with or meeting other users. We strongly recommend reviewing our Safety Tips before engaging with any member.

7. Account Termination and Suspension

The Company reserves the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violations of these Terms or conduct that the Company deems harmful to other users or the integrity of the Platform.

• User-Initiated Deletion: You may delete your account at any time through the account settings page. Upon deletion, your profile and associated data will be handled in accordance with our Privacy Policy.
• Appeals: If your account is suspended or terminated and you believe the action was taken in error, you may contact [email protected] to request a review. Appeals are reviewed within 10 business days.
• Effect of Termination: Upon termination, your right to access and use the Platform ceases immediately. Any unused premium subscription credits are non-refundable unless otherwise required by applicable law.

8. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Platform shall first be resolved through good-faith negotiation. If the parties cannot reach a resolution within 30 days, the dispute shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Wilmington, Delaware, and the language of arbitration shall be English.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
